The Affordable Care Act offers new benefits, rights and protections that affect you, your family and/or your business.
One of the most celebrated reforms is that ObamaCare requires insurance companies to cover people with pre-existing health conditions.
Even if you have being denied in the past, you or your family member with a pre-existing condition can now enjoy coverage.
Another important improvement is that insurance companies can’t charge more for people with preexisting conditions and can’t put lifetime or annual dollar limits on Essential Health Benefits for most life threatening sickness.
It is also important to know that all Americans have an option to purchase or be provided with health care based off their income and employment. This way, consumers can buy coverage that fits their needs and their budget.
Guaranteed Issue and Guaranteed Renewal
- A health plan cannot deny someone coverage because of a particular illness or condition.
- There are no waiting periods for coverage associated with certain pre-existing conditions.
- A health plan cannot deny someone coverage because of risk factors like age or gender.
This is a requirement that your health insurance issuer must offer to renew your policy as long as you continue to pay premiums.
The only exception is for grandfathered individual health insurance plans. These plans do not have to cover pre-existing conditions.
If you are covered by a plan that existed March 23, 2010, your plan may be “grandfathered.”
If you have a grandfathered plan, you can switch to a Marketplace plan and immediately get coverage for your pre-existing conditions.
To find out if your plan is grandfathered check your plan’s materials and/or check with your employer or your health plan’s benefits administrator.
